  1. Name and contact details of the person responsible for processing and the company data protection officer

  2. Collection and storage of personal data, and the manner and purpose of its use

    a) When visiting our website www.fkv.de, information is automatically sent to our server’s website through the browser used on your device. This information is temporarily stored in a so-called log file. The following information is thereby recorded without action on your part and stored until such time as it is automatically deleted:
  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the retrieved file,
  • website from which access is carried out (referrer URL),
  • used browser and if necessary, the operating system and name of your access provider.

The afore-mentioned data is processed by us for the following purposes:

  • to ensure a smooth connection set-up of the website,
  • to ensure comfortable use of our website,
  • for evaluation of system security and stability and
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 Para. 1 S. 1 lit. f GDPR. Our justified interest derives from the purposes relating to data collection listed above. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.
Moreover, we employ cookies as well as analytical services when our website is visited. You can find more information on this under numbers 4 and 5 of this data protection statement.

  1. b) Once you have registered for our newsletter, we will use your e-mail address to send you our newsletter on a regular basis, provided you have expressly consented in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR. To receive the newsletter, it is enough to provide an email address.
    It is possible to unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can also send your unsubscribe request at any time to post@fkv.de by email or post.
  2. c) When using our contact form, for questions of any kind we offer you the chance to contact us via the form provided on the website. A valid e-mail address is required for this so that we know who sent the enquiry and can respond to it accordingly. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR based on your freely given consent.
The personal data collected by us for the use of the contact form will be automatically deleted once your enquiry has been handled.

  1. Disclosure of data

    Your personal data will not be disclosed to third parties for purposes other than those listed below. We only pass on your personal data to third parties provided:
  • you have given your express consent to this in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR,
  • the disclosure pursuant to Art. 6 Para. 1 S. 1 lit. a GDPR is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 Para. 1 S. 1 lit. a GDPR, and
  • this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 Para. 1 S. 1 lit. a GDPR.
  1. Cookies

    We employ cookies on our site. This involves small files that are automatically created by your browser and which are stored on your device (laptop, tablet, smartphone, and the like) when you visit our page. Cookies cause no damage to your device, contain no viruses, trojans or other malware.
    Information that arises in each case in connection with the specific end device used is stored in the cookie. This does not mean, however, that we directly receive knowledge of your identity as a result.
    On the one hand, the use of cookies serves to make the use of our website more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after you leave our site.
    In addition, we also use temporary cookies to optimize user friendliness. These are stored on your end device for a specified period. If you visit our site again to make use of our services, your previous visit is automatically recognized as are the entries and settings you have made, so that you do not have to enter them again.
    On the other hand, we employ cookies in order to record statistically the use of our website and to evaluate it for the purpose of optimizing what we offer you (see point 5).
    These cookies enable us automatically to recognize that you have previously visited our website when you return. These cookies are automatically deleted after 14 days.
    The data processed by cookies is required for the purposes mentioned above to safeguard our legitimate interests and those of third parties in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR.
    Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you cannot use all the functions of our website.
  2. Analytics tools

    a) Tracking tools
    The tracking measures listed below and used by us are carried out based on Art. 6 Para. 1 S. 1 lit. f GDPR. The use of tracking measures aims to ensure a needs-based design and the continuous optimization of our website. On the other hand, we use the tracking measures to record statistically the use of our website and to evaluate it for the purpose of optimizing what we offer you. These interests are deemed to be legitimate within the meaning of the afore-mentioned provision.
    The respective data processing purposes and data categories can be found in the corresponding tracking tools.

    i) Google Analytics
    For the purpose of designing and continuously optimizing our pages in line with your needs, we use Google Analytics, a web analysis service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”). In this context, pseudonymized user profiles are created and cookies (see point 4) are used. The information generated by the cookie about your use of this website such as

  • browser type/version,
  • operating system used,
  • referrer URL (previously visited page),
  • host name of accessing computer (IP address),
  • time of server request,

    is transferred to a Google server in the USA and stored there. The information is used to evaluate the usage of the website, to compile reports on website activities and to provide further services associated with the use of the website and the Internet for the purposes of market research and the customized design of these Internet pages. This information may also be passed on to third parties if required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that they cannot be assigned (IP masking). You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that if you do so, you may not be able to utilize the full functionality of this website.

    You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address), and the processing of this data by Google, by downloading (at Browser-Add-on herunterladen) and installing a browser add-on. As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on this link. An opt-out cookie is set to prevent the future collection of your data when you visit this website. The opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.     ii) Google Adwords Conversion Tracking

    We also use Google Conversion Tracking to record statistically the use of our website and to evaluate it so as to optimize our website for you. This involves Google Adwords placing a cookie (see point 4) on your computer if you have reached our website via a Google advert.
    These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.
    Each Adwords customer receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers learn the total number of users who clicked on their advert and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to identify users personally.
    Should you not wish to participate in the tracking process, you can also reject the setting of a cookie required for this – for example, by changing your browser settings to generally deactivate the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser so that cookies from the domain “googleadservices.com” are blocked.     6. Social Media Plug-ins
    We use social plugins from the Facebook, Twitter and Instagram social networks on our website based on Art. 6 Para. 1 S. 1 lit. f GDPR to promote the Frankfurter Kunstverein. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the GDPR. Responsibility for operation compliant with data protection regulations must be guaranteed by the respective provider. These plugins are integrated by us by means of the so-called two-click method to protect visitors to our website in the best possible way.

    a) Facebook
    Social media plugins from Facebook are used on our website to personalize their use. We use the “LIKE” or “SHARE” button for this purpose – an offer from Facebook.
    When you visit a page on our website containing such a plugin, your browser establishes a direct connection to the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser, which integrates it into the website.
    By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA, where it is stored.
    If you are logged in to Facebook, Facebook can directly match your visit to our website with your Facebook account. If you interact with the plugins, for example by clicking the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server, where it is stored. The information is also published on Facebook and displayed to your Facebook friends.
    This information may be used by Facebook for the purposes of advertising, market research and customizing Facebook pages. For this purpose, Facebook creates usage, interest, and relationship profiles, e.g. to analyze your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website and to provide other services linked to the use of Facebook.
    If you do not wish Facebook to match data to your Facebook account that has been collected via our web presence, you need to log out of Facebook before visiting our website.

    b) Twitter
    Plugins of the short formal social network of Twitter Inc (Twitter) are integrated on our website pages. The Twitter plugins (tweet button) can be recognized by the Twitter logo on our site. An overview of tweet buttons can be found here. When you access a page on our website containing such a plugin, a direct connection is established between your browser and the Twitter server. In this way, Twitter receives the information that you have visited our site with your IP address. If you click on the Twitter “tweet button” while logged into your Twitter account, you can link the content of our pages to your Twitter profile. This allows Twitter to match your visit to our website to your user account. Please note that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Twitter.

    7. Rights of data subjects
    :

  • to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you may request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to correction, deletion, restriction of said processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information about its details;
  • to request immediately the correction of any incorrect or incomplete personal data stored by us of in accordance with Art. 16 GDPR;
  • to request the deletion of your personal data stored by us, unless the processing is necessary for exercising right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for the assertion, exercise, or defense of legal claims in accordance with Art. 17 GDPR;
  • to request the restriction of the processing of your personal data insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
  • to request to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request transmission to another responsible person in accordance with Art. 21 GDPR;
  • to revoke your consent once given to us at any time. This means we may no longer continue the data processing based on this consent in future in accordance with Art. 7 Para. 3 GDPR and
  • to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact for this purpose the supervisory authorities in your habitual place of abode or at your workplace, or the location of the Frankfurter Kunstverein in Frankfurt am Main.
  1. Right of objection
    If data relating to your person is processed on the basis of legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR, you have the right to object to the processing of such data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.

  1. Data security
    We employ the widespread SSL (Secure Sockets Layer) method together with the highest level of encryption supported by your browser when you visit our website. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether an individual page of our website is transmitted in encrypted form can be recognized by the closed display of the key or lock symbol in the lower status bar of your browser.
    Otherwise, we use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
  2. Current status and changes to this data protection statement
    This data protection statement is valid at present as of May 2023.
    It may become necessary to amend this data protection statement due to the further development of our website and related services, or due to changed legal or official guidelines. The current data protection statement can be retrieved at any time on our website at www.fkv.de.
